Samenvatting

Met de Omgevingswet wil het kabinet op effectieve wijze ruimte voor ontwikkeling creëren en tegelijkertijd de kwaliteit van de leefomgeving waarborgen. Procesmatig wordt ermee beoogd de regelgeving te vereenvoudigen, te bundelen en meer in samenhang te brengen en tevens de besluitvorming over projecten in de leefomgeving te versnellen en verbeteren. In aanloop naar de wet heeft het RIVM geïnventariseerd welke knelpunten er in de huidige wetgeving bestaan bij het gebruik van normen. Vervolgens is geanalyseerd hoe die knelpunten zijn te verhelpen om de Omgevingswet daadwerkelijk effectief en doelmatig te laten zijn. Hiertoe heeft het RIVM een denkraam ontwikkeld voor de wetgever en de bestuursorganen die bij de uitvoering van de Omgevingswet zijn betrokken. Het denkraam helpt om de benodigde keuzes te maken over de wijze waarop de normen het beste kunnen worden gecombineerd met de kerninstrumenten die in de wet zijn opgenomen (omgevingsvisie, programmatische aanpak, algemene rijksregels, decentrale regelgeving, projectbesluit en omgevingsvergunning). Om de samenvoeging van de huidige wetten effectief te maken, is het nodig om het gebruik van de normen te harmoniseren en te differentiëren. Om de veelheid aan normen te kunnen harmoniseren, is een onderscheid gemaakt in zeven typen normen. Dit maakt het mogelijk om voor de diverse sectoren te verduidelijken waar de normen voor zijn bedoeld. Op die manier is de keuze voor een bepaalde norm te vereenvoudigen. Daarnaast is het van belang om de normen, afhankelijk van de situatie, gedifferentieerd in te zetten. Bij kleinere en relatief routinematige beslissingen kan bijvoorbeeld gewerkt worden met uniforme prestatie-eisen, gestandaardiseerde vergunningaanvragen en eenvoudige procedures. Bij complexere gevallen zijn maatwerk en bestuurlijke afwegingen van kansen en risico's en van kosten en baten nodig. Verder is het passend om normen in te zetten voor innovatie, bijvoorbeeld door te stimuleren om steeds de schoonste en veiligste technieken te gebruiken. Op die manier is de kwaliteit van de leefomgeving te verbeteren of wordt het mogelijk dat in de toekomst meer activiteiten binnen een beperkte ruimte plaatsvinden. Ook is het van belang de oplossingen die verschillende sectoren gaandeweg in de praktijk hebben gevonden voor knelpunten in de bestaande wetgeving, breder in te zetten. Ten slotte is de doelmatigheid van normen in de omgevingswet onlosmakelijk verbonden met de bevoegdheidsverdeling tussen overheden. Het is daarbij wenselijk de bestuurlijke verantwoordelijkheden te koppelen aan het niveau (van lokaal tot Europees) waarop de effecten zich manifesteren en waarbij het overheidshandelen het meest effectief is.

Abstract

The Dutch government's intention in introducing the Omgevingswet (Environment Planning Act) is to effectively provide opportunities for developments in the physical environment while also safeguarding its quality. The Act serves to simplify overall legislation, combining and collating existing aspects, thus improving and shortening decision-making procedures. As part of the preparations for the Act, the National Institute for Public Health and the Environment (RIVM) analysed the obstacles inherent in existing legislation with regard to the application of standards. The researchers then considered how those obstacles could be removed or mitigated to render the new Act fully effective. RIVM has developed a framework to guide the legislator and the executive agencies involved in the implementation of the Act. It will assist them in making the necessary decisions about how the standards can best be combined with the key instruments provided by the Act (such as the environment and planning vision document, the programmatic approach, regulations at the national level, regulations at regional and local level, the project decision and the planning permit). To ensure effective integration with current legislation, it is necessary to pursue both harmonization and differentiation in the use of standards. Those standards are many and various. For the purposes of harmonization, they have been classified into seven categories. This makes their intent and purpose clear, thus facilitating the selection of the most appropriate standard in any given situation. It is also important to apply some differentiation in their use, again depending on the specific situation. In the case of relatively routine decisions, an adequate approach is provided by uniform performance requirements, standardized permit applications and the simpler 'light' procedures. In more complex cases, an individualized approach with a full analysis of opportunities, threats, costs and returns will be necessary. It is also appropriate to apply standards in pursuit of innovation, e.g. incentivizing the use of only the cleanest and safest technologies. This will help to improve the quality of the physical environment or will ensure that additional or alternative usages can be introduced at a later date, regardless of the spatial constraints. Legislation must make greater use of the solutions which have been developed by the various sectors over time, based on their practical experience. In addition, the effectiveness of the standards within the new legislation will rely on an appropriate division of responsibilities between the various levels of government. It is therefore desirable to define the administrative tasks of each level (from local to European) according to where the actual effects are manifest and where government intervention will be most effective.
